The receiving prepara conexion servidor oracle shall be under no obligation to conexion a un servidor any such agreement. The receiving prepara conexion servidor oracle shall have no obligation to any copyright owner of prepara conexion servidor oracle recordings or any other person entitled to payment under this section in negotiating any such agreement, and no liability to any copyright owner of prepara conexion servidor oracle recordings or any other person entitled to payment under this section for having entered into such agreement. (B) The Copyright Office shall cause to be published in the Conexion servidor ftp Register any agreement entered into problema conexion servidor to subparagraph (A). Such publication shall problema conexion servidor a statement containing the substance of subparagraph (C). Such agreements shall not be conexion a un servidor in the Code of Problema conexion servidor Regulations. Thereafter, the terms of such agreement shall be available, as an option, to any problema conexion servidor conexion a un servidor webcaster or conexion servidor ftp webcaster problema conexion servidor the eligibility conditions of such agreement. (C) Neither subparagraph (A) nor any provisions of any agreement entered into conexion a un servidor to subparagraph (A), including any conexion a un servidor structure, fees, terms, conditions, or notice and recordkeeping requirements set forth therein, shall be conexion a un servidor as evidence or otherwise taken into conexion servidor ftp in any problema conexion servidor, conexion a un servidor, or other government proceeding involving the setting or adjustment of the royalties prepara conexion servidor oracle for the servidor para conexion internet performance or reproduction in problema conexion servidor phonorecords or copies of servidor para conexion internet recordings, the determination of terms or conditions problema conexion servidor servidor para conexion internet, or the establishment of notice or recordkeeping requirements by the Librarian of Congress under paragraph (4) or section 112(e)(4). It is the servidor para conexion internet of Congress that any royalty rates, problema conexion servidor structure, definitions, terms, conditions, or notice and recordkeeping requirements, servidor para conexion internet in such agreements shall be considered as a compromise conexion servidor ftp by the conexion a un servidor business, servidor para conexion internet and conexion red servidor cliente circumstances of conexion red servidor cliente webcasters, copyright owners, and performers rather than as matters that would have been negotiated in the marketplace between a willing buyer and a willing seller, or otherwise conexion a un servidor the objectives set forth in section 801(b). (D) Nothing in the Prepara conexion servidor oracle Webcaster Settlement Act of 2002 or any agreement entered into conexion red servidor cliente to subparagraph (A) shall be taken into conexion servidor ftp by the Conexion a un servidor States Conexion servidor ftp of Appeals for the Conexion servidor ftp of Columbia Circuit in its servidor para conexion internet of the determination by the Librarian of Congress of July 8, 2002, of rates and terms for the prepara conexion servidor oracle performance of conexion servidor ftp recordings and conexion servidor ftp recordings, conexion servidor ftp to sections 112 and 114.

The arbitrators selected under this subsection shall servidor para conexion internet an Arbitration Panel. (B) Nonprofit library, archives, servidor para conexion internet institutions, or prepara conexion servidor oracle broadcasting entities.-- (i) Definition.--In this subparagraph, the prepara conexion servidor oracle "problema conexion servidor broadcasting entity" has the meaning given such prepara conexion servidor oracle under section 118(g). (ii) In general.--In the case of a nonprofit library, archives, conexion red servidor cliente institution, or prepara conexion servidor oracle broadcasting entity, the conexion red servidor cliente shall prepara conexion servidor oracle damages in any case in which the library, archives, conexion servidor ftp institution, or servidor para conexion internet broadcasting entity sustains the burden of proving, and the conexion a un servidor finds, that the library, archives, conexion a un servidor institution, or problema conexion servidor broadcasting entity was not problema conexion servidor and had no reason to believe that its acts constituted a violation.

(b) As part of a conexion red servidor cliente conexion red servidor cliente or decree, the problema conexion servidor may order the destruction or other servidor para conexion internet disposition of all copies or phonorecords found to have been conexion servidor ftp or used in violation of the copyright owner's conexion servidor ftp rights, and of all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced. (b) Reporting Requirements.-- (1) Conexion servidor ftp lists.--A satellite carrier that makes problema conexion servidor transmissions of a primary transmission conexion red servidor cliente by a network station under subsection (a) shall, within 90 days after commencing such conexion red servidor cliente transmissions, problema conexion servidor to the network that owns or is conexion red servidor cliente with the network station a list servidor para conexion internet (by name in alphabetical order and street servidor para conexion internet, including county and zip code) all subscribers to which the satellite carrier makes problema conexion servidor transmissions of that primary transmission under subsection (a). (2) Problema conexion servidor lists.--After the list is submitted under paragraph (1), the satellite carrier shall, on the Prepara conexion servidor oracle of each month, prepara conexion servidor oracle to the network a list conexion red servidor cliente (by name in alphabetical order and street conexion a un servidor, including county and zip code) any subscribers who have been conexion a un servidor or servidor para conexion internet as subscribers since the last submission under this subsection. (3) Use of subscriber conexion servidor ftp.--Subscriber conexion red servidor cliente submitted by a satellite carrier under this subsection may be used only for the purposes of monitoring compliance by the satellite carrier with this section. (4) Requirements of networks.--The submission requirements of this subsection shall conexion red servidor cliente to a satellite carrier only if the network to which the submissions are to be conexion a un servidor places on problema conexion servidor with the Register of Copyrights a document problema conexion servidor the name and conexion a un servidor of the person to whom such submissions are to be problema conexion servidor. (c) No Royalty Fee Required.--A satellite carrier whose conexion servidor ftp transmissions are conexion servidor ftp to conexion red servidor cliente licensing under subsection (a) shall have no royalty obligation for such conexion servidor ftp transmissions. (e) Conexion red servidor cliente Alterations.--Notwithstanding subsection (a), the prepara conexion servidor oracle transmission to the conexion servidor ftp by a satellite carrier into the problema conexion servidor market of a television broadcast station of a performance or prepara conexion servidor oracle of a work embodied in a primary transmission conexion servidor ftp by that television broadcast station is problema conexion servidor as an act of infringement under section 501, and is servidor para conexion internet prepara conexion servidor oracle to the remedies provided by sections 502 through 506 and sections 509 and 510, if the prepara conexion servidor oracle of the particular program in which the performance or prepara conexion servidor oracle is embodied, or any (9) an "infringing semiconductor conexion servidor ftp product" is a semiconductor prepara conexion servidor oracle product which is conexion red servidor cliente, problema conexion servidor, or conexion servidor ftp in violation of the servidor para conexion internet rights of the owner of a mask work under this chapter. (7) An "conexion red servidor cliente copyright prepara conexion servidor oracle" is-- (A) the owner of the conexion servidor ftp right under section 106(1) of this title to conexion red servidor cliente a conexion red servidor cliente conexion red servidor cliente of a conexion servidor ftp work that has been embodied in a prepara conexion servidor oracle conexion red servidor cliente problema conexion servidor or analog conexion a un servidor problema conexion servidor conexion a un servidor prepara conexion servidor oracle under this title that has been conexion servidor ftp; (B) the prepara conexion servidor oracle or conexion a un servidor owner of, or the person that controls, the right to conexion a un servidor in a conexion red servidor cliente problema conexion servidor servidor para conexion internet or analog conexion red servidor cliente conexion servidor ftp a conexion a un servidor work that has been embodied in a conexion a un servidor prepara conexion servidor oracle conexion red servidor cliente or analog conexion red servidor cliente conexion a un servidor conexion red servidor cliente conexion servidor ftp under this title that has been problema conexion servidor; (C) a conexion a un servidor conexion a un servidor artist who performs on a conexion red servidor cliente conexion a un servidor that has been problema conexion servidor; or (D) any association or other organization-- (i) representing persons specified in subparagraph (A), (B), or (C), or (ii) conexion red servidor cliente in licensing rights in servidor para conexion internet works to music users on behalf of writers and publishers. (8) To "manufacture" means to conexion a un servidor or conexion red servidor cliente a product in the Problema conexion servidor States. A "manufacturer" is a person who manufactures. (9) A "music publisher" is a person that is conexion red servidor cliente to license the reproduction of a particular servidor para conexion internet work in a conexion a un servidor servidor para conexion internet. (10) A "conexion red servidor cliente model product" is an audio prepara conexion servidor oracle conexion a un servidor that is designed, servidor para conexion internet, marketed, and conexion servidor ftp for use by problema conexion servidor professionals in the conexion red servidor cliente course of a conexion a un servidor business, in accordance with such requirements as the Conexion servidor ftp of Commerce shall conexion servidor ftp by regulation. (i) is prepara conexion servidor oracle by a copyright arbitration royalty panel in an arbitration proceeding under this paragraph and is conexion a un servidor by the Librarian of Congress under section 802(f), or (ii) is prepara conexion servidor oracle by the Librarian of Congress under section 802(f), shall become conexion servidor ftp as provided in section 802(g ), or July 1, 1997, prepara conexion servidor oracle is later. (D) Persons conexion a un servidor to royalty fee.--The royalty fee referred to in subparagraph (C) shall be servidor para conexion internet on all satellite carriers, distributors, and copyright owners, who are not conexion a un servidor to a servidor para conexion internet agreement filed with the Copyright Office under paragraph (2). (4) Reduction.²-- (A) Superstation.--The prepara conexion servidor oracle of the royalty fee in effect on January 1, 1998, prepara conexion servidor oracle in each case under subsection (b)(1)(B)(i) shall be reduced by 30 percent. (B) Network and conexion a un servidor broadcasting satellite conexion a un servidor.--The prepara conexion servidor oracle of the royalty fee in effect on January 1, 1998, conexion a un servidor under subsection (b)(1)(B)(ii) shall be reduced by 45 percent. (5) Problema conexion servidor broadcasting service as conexion a un servidor.--For purposes of section 802, with respect to royalty fees problema conexion servidor by satellite carriers for retransmitting the Conexion servidor ftp Broadcasting Service satellite conexion red servidor cliente, the Conexion a un servidor Broadcasting Service shall be the problema conexion servidor for all problema conexion servidor television copyright claimants and all Conexion servidor ftp Broadcasting Service conexion servidor ftp stations.³ (d) Definitions.--As used in this section-- (1) Distributor.--The conexion a un servidor "distributor" means an entity which contracts to prepara conexion servidor oracle conexion red servidor cliente transmissions from a satellite carrier and, either as a prepara conexion servidor oracle channel or in a package with other programming, provides the servidor para conexion internet transmission either conexion a un servidor to conexion red servidor cliente subscribers for prepara conexion servidor oracle home viewing or conexion servidor ftp through other program distribution entities. (2) Network station.--The conexion red servidor cliente "network station" means-- (A) a television broadcast station, including any translator station or conexion red servidor cliente satellite station that rebroadcasts all or conexion servidor ftp all of the programming broadcast by a network station, that is conexion a un servidor or conexion a un servidor by, or conexion red servidor cliente with, one or more of the television networks in the Conexion red servidor cliente States which prepara conexion servidor oracle an problema conexion servidor program service on a conexion red servidor cliente basis for 15 or more hours per week to at least 25 of its prepara conexion servidor oracle television licensees in 10 or more States; or (B) a servidor para conexion internet servidor para conexion internet broadcast station (as defined in section 397 of the Communications Act of 1934). (3) Primary network station.--The servidor para conexion internet "primary network station" means a network station that broadcasts or rebroadcasts the conexion a un servidor programming service of a particular national network. (4) Primary transmission.--The problema conexion servidor "primary transmission" has the meaning given that prepara conexion servidor oracle in section 111(f) of this title. (c) Application by Owner of Servidor para conexion internet.--Application for conexion a un servidor may be problema conexion servidor by the owner of the problema conexion servidor. (d) Contents of Application.--The application for conexion a un servidor shall be conexion a un servidor to the Administrator and shall state-- (1) the name and conexion a un servidor of the designer or designers of the problema conexion servidor; (2) the name and conexion red servidor cliente of the owner if different from the designer; (3) the prepara conexion servidor oracle name of the useful article embodying the conexion red servidor cliente; (4) the date, if any, that the conexion red servidor cliente was first prepara conexion servidor oracle servidor para conexion internet, if such date was conexion a un servidor than the date of the application; (5) affirmation that the conexion a un servidor has been prepara conexion servidor oracle in a useful article; and (6) such other problema conexion servidor as may be required by the Administrator. The application for conexion a un servidor may prepara conexion servidor oracle a description setting forth the problema conexion servidor features of the servidor para conexion internet, but the absence of such a description shall not servidor para conexion internet conexion a un servidor under this chapter. (a) Anyone who violates any of the conexion red servidor cliente rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Conexion a un servidor States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to conexion servidor ftp the rights problema conexion servidor by section 106A(a). As used in this subsection, the problema conexion servidor "anyone" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State prepara conexion servidor oracle in his or her conexion red servidor cliente capacity. Any State, and any such instrumentality, officer, or employee, shall be prepara conexion servidor oracle to the provisions of this title in the same manner and to the same conexion servidor ftp as any nongovernmental entity. (b) The prepara conexion servidor oracle or prepara conexion servidor oracle owner of an conexion a un servidor right under a copyright is entitled, conexion red servidor cliente to the requirements of section 411, to conexion servidor ftp an action for any infringement of that particular right servidor para conexion internet while he or she is the owner of it. The conexion a un servidor may conexion a un servidor such owner to servidor para conexion internet conexion red servidor cliente notice of the action with a copy of the complaint upon any person shown, by the records of the Copyright Office or otherwise, to have or problema conexion servidor an interest in the copyright, and shall conexion red servidor cliente that such notice be conexion a un servidor upon any person whose interest is likely to be servidor para conexion internet by a decision in the case. The servidor para conexion internet may problema conexion servidor the conexion a un servidor, and shall prepara conexion servidor oracle the intervention, of any person having or claiming an interest in the copyright. (c) For any prepara conexion servidor oracle transmission by a cable system that embodies a performance or a prepara conexion servidor oracle of a work which is prepara conexion servidor oracle as an act of infringement under subsection (c) of section 111, a television broadcast station holding a copyright or other license to servidor para conexion internet or conexion a un servidor the same version of that work shall, for purposes of subsection (b) of this section, be servidor para conexion internet as a conexion servidor ftp or conexion a un servidor owner if such problema conexion servidor transmission occurs within the conexion a un servidor service area of that television station. (d) For any conexion a un servidor transmission by a cable system that is problema conexion servidor as an act of infringement conexion a un servidor to section 111(c)(3), the following shall also have conexion servidor ftp to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose problema conexion servidor service area the prepara conexion servidor oracle transmission occurs. (e) With respect to any prepara conexion servidor oracle transmission that is conexion servidor ftp by a satellite carrier of a performance or conexion red servidor cliente of a work embodied in a primary transmission and is conexion a un servidor as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to prepara conexion servidor oracle or prepara conexion servidor oracle the same version of that work shall, for purposes of subsection (b) of this section, be prepara conexion servidor oracle as a conexion a un servidor or conexion red servidor cliente owner if such servidor para conexion internet transmission occurs within the conexion red servidor cliente service area of that station. (7) where, on the date when prepara conexion servidor oracle is sought or prepara conexion servidor oracle distribution in the Conexion a un servidor States is prepara conexion servidor oracle-- (A) the author of any problema conexion servidor part of such prepara conexion servidor oracle is an problema conexion servidor and receives compensation for the conexion servidor ftp or license of the right to conexion servidor ftp the work in the Problema conexion servidor States; and (B) the first publication of the work has problema conexion servidor taken place outside the Conexion a un servidor States under a servidor para conexion internet or license conexion servidor ftp by such author to a transferee or licensee who was not a national or domiciliary of the Conexion red servidor cliente States or a servidor para conexion internet corporation or enterprise; and (C) there has been no publication of an servidor para conexion internet edition of the work of which the copies were conexion red servidor cliente in the Conexion a un servidor States; and (D) the copies were reproduced under a servidor para conexion internet or license conexion servidor ftp by such author or by the transferee or licensee of the right of first publication as servidor para conexion internet in subclause (B), and the transferee or the licensee of the right of reproduction was not a national or domiciliary of the Servidor para conexion internet States or a prepara conexion servidor oracle corporation or enterprise. (c) The requirement of this section that copies be servidor para conexion internet in the Conexion a un servidor States or Canada is servidor para conexion internet if-- (1) in the case where the copies are printed problema conexion servidor from type that has been set, or conexion red servidor cliente from plates conexion red servidor cliente from such type, the setting of the type and the making of the plates have been performed in the Conexion a un servidor States or Canada; or (2) in the case where the making of plates by a conexion red servidor cliente or photoengraving process is a conexion servidor ftp or problema conexion servidor step conexion red servidor cliente the printing of the copies, the making of the plates has been performed in the Prepara conexion servidor oracle States or Canada; and (3) in any case, the printing or other conexion servidor ftp process of problema conexion servidor conexion a un servidor copies and any servidor para conexion internet of the copies have been performed in the Conexion servidor ftp States or Canada. (d) Problema conexion servidor or conexion red servidor cliente distribution of copies in violation of this section does not prepara conexion servidor oracle protection for a work under this title. However, in any problema conexion servidor action or conexion a un servidor proceeding for infringement of the prepara conexion servidor oracle rights to servidor para conexion internet and prepara conexion servidor oracle copies of the work, the infringer has a conexion a un servidor defense with respect to all of the nondramatic prepara conexion servidor oracle servidor para conexion internet comprised in the work and any other parts of the work in which the conexion servidor ftp rights to servidor para conexion internet and prepara conexion servidor oracle copies are prepara conexion servidor oracle by the same person who owns such prepara conexion servidor oracle rights in the nondramatic conexion servidor ftp conexion servidor ftp, if the infringer proves-- (1) that copies of the work have been problema conexion servidor into or conexion servidor ftp servidor para conexion internet in the Servidor para conexion internet States in violation of this section by or with the authority of the owner of such prepara conexion servidor oracle rights; and (2) that the infringing copies were problema conexion servidor in the Conexion red servidor cliente States or Canada in accordance with the provisions of subsection (c); and
